Terms of Use
The short version
This site shows properties we are instructed to sell or let in Rio de Janeiro, and publishes guides about buying, renting and investing here. The listings are an invitation to talk to us, not a binding offer, and the details come largely from owners — verify them before you commit.
The guides are information, not legal, tax or investment advice. Nothing on this page limits the rights Brazilian consumer law gives you. How we handle personal data is a separate document: our Privacy Policy.
These terms govern your use of oabitat.com. By browsing the site, sending an enquiry or booking a viewing, you accept them. If you do not, please do not use the site.

We are a licensed real estate brokerage. Brokerage in Brazil is regulated by Lei nº 6.530/1978 and by the COFECI/CRECI system, and only registered professionals may broker property. Our registration number appears on this site, in our advertising and on our documents, as Resolution COFECI nº 1.065/2007 requires.
Our registered activities are brokerage in the purchase, sale and valuation of property (CNAE 68.21-8-01), brokerage in the letting of property (68.21-8-02) and the management and administration of property (68.22-6-00). The company has traded since November 2022.
2. What this website is
The site does three things: it presents properties we have been instructed to sell or let, it explains how the Rio market and Brazilian property law work, and it gives you a way to reach us.
It is not a transaction platform. You cannot buy, reserve or rent a property through this website. Every transaction runs through a signed contract, and it is that contract — not a page on this site — that sets out what each party owes the other.
3. Listings are an invitation to negotiate
A listing here is an invitation to contact us about a property, not a binding offer capable of acceptance. Availability, price and terms change, sometimes between one day and the next, and a property may be under offer before the page is updated.
We describe properties accurately and in good faith, and we correct errors as soon as we learn of them — if you spot one, tell us. Where we have got something wrong, Brazilian consumer law applies to us in the ordinary way; nothing here is intended to displace it.
Information that comes from third parties
Floor areas, condominium charges, IPTU, year of construction and building specifications are generally supplied by owners, administrators or developers. Photographs may be taken at a different time from your visit, and computer-generated images of new developments show a design intention rather than a finished apartment.
Before you commit to anything, these figures should be checked against source documents — the registry entry (matrícula), the condominium’s own statements, the municipal records and, on a new development, the registered memorial de incorporação. We will help you obtain them; verifying them is part of a proper purchase.
4. Our role as broker
Brokerage is governed by Articles 722 to 729 of the Brazilian Civil Code. Our function is to bring the parties together and to conduct the negotiation with the diligence the law requires, keeping you informed of anything that could affect the outcome, including any risk we become aware of.
Commission is due when the result contracted for is achieved, as Article 725 provides. Who pays it, how much it is, and when it falls due are agreed in writing before we act — never assumed from this website.
We are not a party to the sale or the lease. We do not hold client money for transactions, and where a property is managed by us that arrangement is covered by a separate management contract.
5. The guides are information, not advice
Our Knowledge Base explains Brazilian tenancy law, taxes, purchase mechanics, rental yields and neighbourhood markets. It is researched carefully and dated, and we correct it when the law or the data changes.
It remains general information. It is not legal, tax, accounting or investment advice, it is not tailored to your circumstances, and reading it does not create a professional relationship. Where a decision turns on the detail — a contract clause, a tax position, a residency question — take advice from a Brazilian lawyer or accountant. We can introduce you to professionals we work with; they act for you, not for us.
6. Content and intellectual property
The text, photographs, floor plans, videos, guides and design on this site belong to Oabitat or to the owners and photographers who licensed them to us. They are protected by Lei nº 9.610/1998.
You are welcome to read, print and share pages for your own use, and to quote us with a link. You may not copy listings or guide content onto another website, republish our photographs, or use any of it commercially without our written permission. Automated collection — scraping, crawling for republication, bulk downloading of images or listing data — is not permitted.
7. Using the site properly
When you use this site, you agree not to:
- submit false information, or enquire in someone else’s name without their authority;
- attempt to gain access to any part of the site, its server or its database that is not public;
- interfere with the site’s operation or security, or introduce malicious code;
- use the contact forms to send advertising or unsolicited commercial messages.
Anything you send us through the site — an enquiry, a document, a photograph of a property you want to sell — you confirm you are entitled to send, and you allow us to use it for the purpose you sent it for.
8. Links to other websites
We link to public sources: registries, the tax authorities, market indices, news, developers. Those sites are outside our control and we are not responsible for their content or their privacy practices. A link is not an endorsement.
9. Availability of the site
We aim to keep the site available and accurate, but we do not guarantee uninterrupted access. Maintenance, hosting problems and connectivity failures happen. We may change, suspend or withdraw any part of the site, including individual listings, at any time and without notice.
10. Liability
We are liable for our own conduct as a broker under Brazilian law, and for the accuracy of what we tell you within the limits set out above. We are not liable for decisions taken without verifying source documents, for the acts of the other party to a transaction, or for loss caused by matters outside our control.
Where you deal with us as a consumer, the Code of Consumer Protection (Lei nº 8.078/1990) applies, and nothing in these terms excludes or restricts any right it gives you. Any clause here that conflicts with it is to be read as limited to the extent the law permits, and the rest of these terms continue to apply.
11. If you contract a service online
Where you engage a service from us at a distance — by e-mail, telephone or through this site rather than at our office — Article 49 of the Code of Consumer Protection gives you seven days from signature or from receipt of the service to withdraw, with any amounts paid returned. Tell us in writing within that period and we will act on it.
12. Personal data
How we collect, use, share and delete personal data, the legal basis for each activity, how long we keep it and the rights you have under the LGPD are set out in our Privacy Policy, which forms part of these terms.
13. Changes to these terms
We may update these terms as our services or the law change. The current version is always the one on this page, with its date at the top. Continuing to use the site after a change means you accept the revised terms; the version in force when a transaction was agreed governs that transaction.
14. Governing law and jurisdiction
These terms are governed by Brazilian law. Disputes are subject to the courts of the Comarca da Capital do Rio de Janeiro, except that where you deal with us as a consumer you may bring proceedings in the court of your own domicile, as Article 101 of the Code of Consumer Protection allows.
If a term affects a decision you are about to take, ask us before you take it. We would rather explain it now than argue about it later.
This page is published in several languages. In the event of any divergence between versions, the Portuguese text prevails, as Brazilian law governs these terms. See also our Privacy Policy.
