Under Brazil’s current immigration framework, a foreign investor who acquires one or more urban properties with a total investment of at least R$1 million may qualify for a residence authorization based on real estate investment. For properties located in Brazil’s North and Northeast regions, the minimum threshold can be reduced by up to 30%, to R$700,000. The framework is established by Normative Resolution No. 36/2018, as amended by subsequent regulations.

The process is commonly associated with VITEM IX (Investment) when the applicant is applying from outside Brazil. However, it is important to distinguish the visa from the underlying residence authorization: the residence authorization must be approved first, after which the temporary visa can be issued by the relevant Brazilian consular authority.

The initial residence authorization for a real estate investor is granted for four years. After this period, it may be converted to an indefinite-term residence authorization, provided the applicable requirements are met. Investors must also maintain a minimum physical presence in Brazil of 14 days, consecutive or otherwise, during each two-year period following registration with the Federal Police.
